13ZZAD: Later decision on work performed by employees covered by claim

If the Authority or the court makes a decision under section 13ZY(1)(c)(ii) about a claim, this section applies. You need to know what the decision says about the work performed by employees covered by the claim. The decision will say if the employees do the same or similar work.

If the decision says all employees do the same or similar work, the claim is no longer stopped and the parties must keep assessing the pay equity claim under section 13ZD. You will follow the rules in this section to continue with the claim.

If the decision says the employees do not all do the same or similar work, the claim stays stopped from the date the employer told the claimant about the decision.

13ZZADLater decision on work performed by employees covered by claim

  1. This section applies if the Authority or the court makes a determination under section 13ZY(1)(c)(ii) in relation to a decision referred to in section 13ZZA(2)(d).

  2. If the determination is that all of the employees covered by the claim perform work that is the same or substantially similar,—

  3. the claim is no longer discontinued; and
    1. the parties must resume the assessment of the pay equity claim under section 13ZD.

      1. If the determination is that the employees covered by the claim do not all perform work that is the same or substantially similar, the claim remains discontinued from the date on which the employer gave notice of the decision to the claimant.
