38Requirements relating to seizure and impoundment of boats and motor vehicles

  1. An enforcement officer may seize and impound a boat or motor vehicle under section 37 only if the officer is satisfied on reasonable grounds that the seizure—

  2. is necessary to avoid any risk to the health of the public; or
    1. is necessary for the safety of the public; or
      1. is necessary to protect significant flora or fauna; or
        1. is necessary to ensure access to the local authority area or conservation land concerned; or
          1. is, in the circumstances, the most appropriate action to prevent the ongoing commission of the offence.
