42: Relationship of this Act with other enactments

This Act doesn’t stop local authorities from using their powers under the Local Government Act 2002 or any other law that gives them power.

The Act also doesn’t limit the powers of the Department of Conservation, the New Zealand Transport Agency, or Land Information New Zealand. These organisations can still use their powers under their own laws.

If you have the right to be in an area owned by a local authority, on conservation land, or on land managed by Land Information New Zealand, this Act doesn’t take away those rights. For example, if you have a special right to stay somewhere (like a nohoanga entitlement), you can still use that right.

In Auckland, the Auckland Council can use its powers under this Act for any local area that’s part of Auckland’s transport system, even though there’s another law about Auckland’s transport.

42Relationship of this Act with other enactments

  1. This Act does not limit or affect the powers of a local authority under the Local Government Act 2002 or any other enactment that confers powers on a local authority.

  2. This Act does not limit or affect the following powers:

  3. the powers of the Department under the conservation Acts:
    1. the powers of the NZTA under the transport Acts:
      1. the powers of LINZ under the Crown land Acts.
        1. This Act does not limit or affect any rights a person may have under any enactment to occupy a local authority area, conservation land, or LINZ land (for example, rights of occupation under a nohoanga entitlement).

        2. Nothing in section 50 of the Local Government (Auckland Council) Act 2009 limits or prevents the Auckland Council from exercising its powers under this Act in respect of a local authority area that forms part of the Auckland transport system (as that term is defined in section 37(1) of that Act).
