33: Territorial authority's consent to disposal of dangerous dog

If you want to get rid of a dog that is classified as a dangerous dog, the territorial authority must agree to it. The authority will only agree if they are satisfied that the person getting the dog is not someone who is classified as a probationary owner under section 21. They must also be satisfied that the person is not disqualified under section 25(1)(b) and (c).

The authority must be satisfied that the person knows the dog is classified as a dangerous dog. They must also know about the rules they have to follow as the owner of a dangerous dog, which are outlined in section 32.

The territorial authority has to make sure the person getting the dog meets all these conditions before they can agree to the dog being disposed of to that person.

33Territorial authority's consent to disposal of dangerous dog

  1. No territorial authority shall give its consent under section 32(1)(f) to the disposal to any person of a dog that is classified as a dangerous dog unless the territorial authority is satisfied that the purchaser or transferee—

  2. is not a person classified under section 21 as a probationary owner; and
    1. is not a person who is disqualified under section 25(1)(b) and (c); and
      1. is aware that the dog is classified as a dangerous dog; and
        1. is aware of the obligations imposed by section 32 on the owner of a dog that is classified as a dangerous dog.
