78B: Procedure for bringing Order in Council made under section 78A into force

The Governor-General can make an order to bring another order into force. This other order is made under section 78A. You can read about section 78A here.

The Governor-General can only make this order after the House of Representatives has approved the order made under section 78A. The House of Representatives can approve the order at any time after 28 days have passed since the order was published under the Legislation Act 2019. If the order is published between 24 December and 15 January, the House of Representatives can approve it after 15 February.

If the House of Representatives does not approve the order, or if they do not make a decision within one year, the order will lapse. The Governor-General's order is a type of secondary legislation, which has its own publication requirements, explained in Part 3 of the Legislation Act 2019.

78BProcedure for bringing Order in Council made under section 78A into force

  1. The Governor-General may, by Order in Council, make a commencement order bringing any Order in Council made under section 78A into force.

  2. The commencement order may be made only after the Order in Council made under section 78A has been approved by resolution of the House of Representatives.

  3. A resolution of the House of Representatives approving the Order in Council may be made at any time after—

  4. the date that is 28 days after the date on which the order is published under the Legislation Act 2019; or
    1. if the order is published under the Legislation Act 2019 during the period commencing on 24 December in one year and ending on 15 January in the following year, 15 February of that following year.
      1. An Order in Council made under section 78A lapses if—

      2. a motion to approve the Order in Council is defeated; or
        1. no motion to approve the Order in Council is agreed to within 1 year of its date of making.
          1. An order under subsection (1) is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
