78A: Regulations adding further breed or type to Schedule 4

The Governor-General can change the list of dog breeds or types in Schedule 4 by adding a new breed or type or by moving a breed or type to a different part of the list. You can find the list of dog breeds or types in Schedule 4. The Governor-General can only make these changes if the Minister recommends it.

The Governor-General's changes to the list cannot take effect until a commencement order is made under section 78B. This means that even if the Governor-General makes changes to the list, they will not happen straight away.

When the Governor-General makes an order to change the list, it is considered secondary legislation, which has its own publication requirements, as explained in Part 3 of the Legislation Act 2019.

78ARegulations adding further breed or type to Schedule 4

  1. The Governor-General may, by Order in Council, in accordance with a recommendation of the Minister, amend Schedule 4 by doing 1 or more of the following to the schedule:

  2. adding a further breed or type of dog to the schedule; or
    1. moving the name or description of any dog from part of the schedule to another part of the schedule.
      1. An Order in Council made under subsection (1) may not come into force except in accordance with a commencement order made under section 78B.

      2. An order under subsection (1) is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
