112B: Application for contact information

If you need help finding someone’s contact information to enforce a Tenancy Tribunal order, you can ask the chief executive for help. The chief executive will check if you’ve filled out the application form correctly, paid any fees, and attached a copy of the order. They’ll also make sure you’ve tried to find the person’s contact information yourself first.

If the chief executive thinks a government agency might be able to help, they’ll send your application to that agency. The agency will then search their databases to try and find the person’s contact information.

After searching, the agency will tell the chief executive what they found. If they find the person’s contact information, they’ll give it to the chief executive. If they can’t find any information, or if they think the person might have died, they’ll let the chief executive know that too.

112CApplication referred to specified agency

  1. The chief executive must refer an application under section 112B to a specified agency if—

  2. the application is properly completed, any prescribed fee is paid, and a copy of the relevant order is attached; and
    1. the chief executive is satisfied that the applicant has, before making the application, made reasonable efforts to find contact information about the judgment debtor; and
      1. the chief executive believes on reasonable grounds that a search by a specified agency may find contact information about the judgment debtor that may assist in the enforcement of the Tribunal order.
        1. A specified agency that receives an application forwarded by the chief executive must search its specified databases in order to find contact information that relates to the judgment debtor identified in the application.

        2. After searching its specified databases, the specified agency must,—

        3. if it finds contact information about the judgment debtor, forward it to the chief executive; or
          1. if it does not find contact information about the judgment debtor, or if it believes that the judgment debtor is dead, advise the chief executive of that fact.
