139ARegulations relating to infringement offences

  1. The Governor-General may, by Order in Council made on the recommendation of the Minister, make regulations—

  2. specifying offences in this Act that are infringement offences, and prescribing infringement fees not exceeding $500 for those offences:

      1. Before making a recommendation for the purposes of subsection (1), the Minister must consult the Minister of Justice in relation to the proposed regulations.

      2. Regulations under this section that prescribe infringement fees may prescribe different infringement fees to apply in respect of different classes of persons.

      3. Regulations under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
