41B: Regulations relating to infringement fees

The Governor-General can make rules about fees for breaking the Weights and Measures Act. These rules are called regulations. The Minister must recommend these rules before the Governor-General can make them.

The regulations can do three things:

  1. They can say what infringement notices and reminder notices should look like.
  2. They can say what information needs to be in these notices.
  3. They can set the amount of the fee you have to pay if you break the rules. This fee can’t be more than $2,000.

41BRegulations relating to infringement fees

  1. The Governor-General may, by Order in Council made on the recommendation of the Minister, make regulations for the following purposes:

  2. prescribing the form of infringement notices and reminder notices:
    1. prescribing any particulars that must be included in those notices:
      1. prescribing the amount of an infringement fee, which must not exceed $2,000, payable in respect of an infringement offence for which an infringement notice has been issued.
        1. Regulations under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
