You can ask a Licensing Authority to waive a disqualification. They may agree if you apply in writing and pay a fee. You must meet certain conditions. You can only ask for a waiver when applying for a certificate or licence. A waiver expires when your certificate or licence does. A Licensing Authority can cancel a waiver at any time. A minor offence is one that is not serious. You must have special reasons for the waiver to be granted. The Licensing Authority looks at your character and the nature of any offence.

      1. 1 or both of the following apply to the disqualification:

          1. the disqualification is on 1 or more of the grounds set out in section 22(b) to (h); and
          2. the Licensing Authority is satisfied, on the basis of written material before him or her, that there are special reasons why the person should not be disqualified from holding a certificate taking into account—
            1. the person’s character, circumstances, and background; and
              1. the nature of any offence relevant to the person’s disqualification.
              2. A person who wishes to seek a waiver of disqualification may do so only in connection with an application for a certificate or licence, or an application for renewal of a certificate or licence, or in connection with the cancellation or suspension of a certificate or the cancellation or suspension of a licence.

              3. A waiver expires on the expiry of any certificate or licence to which it relates.

              4. A Licensing Authority may, at any time, cancel a waiver, by notice in writing (with reasons) to the person concerned, if satisfied on reasonable grounds that the waiver should no longer apply.

              5. In this section, minor offence means an offence that is, or the consequences of which are, minor in nature.
