27: Designation of ethics committee

The Minister can choose a committee to be the ethics committee for this part of the law. You need to know that the Minister can choose a committee that they establish or one that already exists for another purpose. The Minister must make sure the committee has the right people on it.

The committee must follow certain standards, which are decided by a committee appointed under section 87 of the Pae Ora (Healthy Futures) Act 2022. The committee must have members with expertise in assisted reproductive procedures and human reproductive research. These members help the committee make good decisions.

The Minister can appoint people to be on the committee or remove them if needed. The Minister decides the terms and conditions for each member, including how much they get paid. If the committee's membership changes, it does not affect its role as the ethics committee.

27Designation of ethics committee

  1. The Minister may, by written notice given to any committee, designate the committee as the ethics committee for the purposes of this Part.

  2. The Minister may designate a committee—

  3. that the Minister establishes for the purposes of this section; or
    1. that has been established for another purpose.
      1. In designating a committee under this section, the Minister must ensure that the committee—

      2. complies in its composition with any applicable standard governing ethics committees determined by any relevant committee appointed under section 87 of the Pae Ora (Healthy Futures) Act 2022; and
        1. includes—
          1. 1 or more members with expertise in assisted reproductive procedures; and
            1. 1 or more members with expertise in human reproductive research.
            2. The committee designated under this section is subject to any applicable ethical standards determined by any relevant committee appointed under section 87 of the Pae Ora (Healthy Futures) Act 2022.

            3. Each meeting of the ethics committee may be attended by the chairperson of the advisory committee or a member of the advisory committee nominated by the chairperson for the meeting, but a person attending under this subsection is not a member of the ethics committee.

            4. If the committee is established for the purposes of this section, the Minister may, by written notice,—

            5. appoint any person to be a member or chairperson of the ethics committee; and
              1. terminate the appointment of a member or chairperson of the ethics committee.
                1. Each member of the ethics committee established for the purposes of this section is appointed on any terms and conditions (including terms and conditions as to remuneration and travelling allowances and expenses) that the Minister determines by written notice to the member.

                2. In order to meet the requirements of subsection (3), the Minister may appoint 1 or more additional members to a committee, being a committee established for another purpose, on any terms and conditions (including terms and conditions as to remuneration and travelling allowances and expenses) that the Minister determines by written notice to the member.

                3. A change in the membership of the committee designated under this section does not affect its designation.
