112: Appointment of acting Judges of Court of Appeal

You can have acting Judges of the Court of Appeal. The Governor-General appoints them with advice from the Attorney-General. They can choose one or more people for this role. You are eligible for this role if you are under 75 years old and have retired or resigned as a Court of Appeal Judge or a High Court Judge. The Governor-General can make this appointment if a Judge is ill or absent, or for another temporary reason. As an acting Judge, you can only do tasks that the President of the Court of Appeal allows you to do. The President can also let you hear and decide cases for a certain amount of time.

Acting Judges

112Appointment of acting Judges of Court of Appeal

  1. The Governor-General may, on the advice of the Attorney-General, appoint 1 or more acting Judges of the Court of Appeal.

  2. A person under the age of 75 years is eligible for appointment under subsection (1) if that person has retired or resigned from office as—

  3. a Court of Appeal Judge; or
    1. a High Court Judge.
      1. An appointment under subsection (1) may be made because of the illness or absence of any Judge of the Court of Appeal, or for any other temporary purpose.

      2. During the term of his or her appointment, an acting Judge of the Court of Appeal may only act to the extent authorised by the President of the Court of Appeal.

      3. An acting Judge of the Court of Appeal may be authorised by the President of the Court of Appeal to hear and determine proceedings within a specified period.
