You can be appointed as an acting Judge for a certain time. This time cannot be more than until you are 75 years old. It also cannot be more than 2 years. When your time as an acting Judge ends, you can be appointed again if you are under 75 years old. You can be appointed for one or more terms again. There is a limit to how many times you can be reappointed. If you are a certain type of acting Judge, like an acting Court of Appeal Judge appointed under section 112 or an acting High Court Judge appointed under section 113, you cannot be reappointed for more than 5 years in total.

116Term of appointment of acting Judges appointed by Governor-General

  1. An appointment under any of sections 111 to 114 must be for a specified term that—

  2. is not more than the time until the Judge will reach the age of 75 years; and
    1. in any case, is not more than 2 years.
      1. When an acting Judge's term of appointment ends, the acting Judge, if under the age of 75 years, may at any time be reappointed for a further 1 or more terms.

      2. However, an acting Judge may not be reappointed for a term that, when aggregated with all previous terms, exceeds 5 years if that acting Judge is—

      3. an acting Court of Appeal Judge appointed under section 112; or
        1. an acting High Court Judge appointed under section 113.
