147High Court Rules part of Act
The High Court Rules set out in Schedule 2 of the Judicature Act 1908 as at the date that this Act receives the Royal assent continue in force and those rules, as altered, amended, added to, or revoked under section 148, are deemed to be part of this Act.
However, the High Court Rules and consolidations of those rules must be published, as the High Court Rules 2016, as if they were secondary legislation (rather than as part of this Act).
The Legislation Act 2019 applies accordingly to the rules published in that way.
The Chief Parliamentary Counsel may add to the rules, as published,—
- minimum legislative information (within the meaning of the Legislation Act 2019); and
- any other information that the Chief Parliamentary Counsel considers to be necessary or appropriate for the purposes of arranging publication of the rules and making them accessible for users.
