160: Review of Registrar's decision concerning fees

You can ask a Judge or Associate Judge to review a decision made by a Registrar or Deputy Registrar about fees. You must apply within 20 working days of being told about the decision, or you can ask for more time. The Judge or Associate Judge can look at your application and make a new decision. You do not have to make your application in a formal way. The Judge or Associate Judge will look at the matter again and make a decision based on the papers, unless they want to hear from you in person. They can agree with the original decision, change it, or cancel it. There is no fee to pay when you make an application. You can make this application if you disagree with a decision made under section 157(1).

160Review of Registrar's decision concerning fees

  1. A person who disagrees with a decision of a Registrar or Deputy Registrar under regulations made under section 157(1) may apply to a Judge or an Associate Judge of the relevant court to review the decision.

  2. The application must be made within—

  3. 20 working days after the date on which the applicant is notified of the decision; or
    1. any further time that the Judge or Associate Judge allows on application, which may be made either before or after the expiry of that period.
      1. The application may be made informally.

      2. A review is—

      3. conducted by way of rehearing of the matter in respect of which the Registrar or Deputy Registrar made the decision; and
        1. dealt with on the papers, unless the Judge or Associate Judge directs otherwise.
          1. The Judge or Associate Judge may confirm, modify, or reverse the decision of the Registrar or Deputy Registrar.

          2. No fee is payable on the application.
