88: Directors of Area Addiction Services in specified areas

The Director has to appoint people to be Directors of Area Addiction Services, also called Area Directors, in certain areas. You need to know that the Director decides how many Area Directors are needed. The Director also decides the terms and conditions for each Area Director, including the area they are responsible for.

The Director must publish a notice in the Gazette to tell people about each new Area Director and the area they are responsible for. If an Area Director is not doing their job properly, they can be suspended or removed from their position by the Director. This can happen if the Area Director fails to do their job, neglects their duties, behaves badly, or cannot do their job.

As part of their job, an Area Director can visit any treatment centre in their area at any time without warning. The Area Director must be allowed to see every part of the treatment centre and every patient in it. When an Area Director visits a treatment centre, they have the same rights as a district inspector, as stated in Section 99(2) and (3).

Every three months, each Area Director must write a report about what they have done in the past three months. They must give this report to the Director.

88Directors of Area Addiction Services in specified areas

  1. The Director must—

  2. appoint as many persons to be Directors of Area Addiction Services (Area Directors) in specified areas as the Director considers necessary; and
    1. determine the terms and conditions on which each Area Director is appointed, including every area for which each Area Director is responsible; and
      1. publish a notice in the Gazette notifying each appointment and any area for which the appointee is responsible.
        1. A person appointed under this section may at any time be suspended or removed from office by the Director for any of the following proved to the satisfaction of the Director:

        2. failure to perform adequately the duties of the office:
          1. neglect of duty:
            1. misconduct:
              1. inability to perform the duties of the office.
                1. For the purposes of performing his or her functions, an Area Director—

                2. may, at any time and without previous notice, visit any treatment centre located in the area for which that Area Director is responsible; and
                  1. must be given access to every part of the treatment centre and to every patient in it.
                    1. Section 99(2) and (3) applies in relation to an Area Director’s visit to a treatment centre under subsection (3) as if the Area Director were a district inspector.

                    2. Every Area Director must, every 3 months,—

                    3. prepare a written report on the exercise and performance of his or her functions, duties, and powers under this Act for the previous 3 months; and
                      1. give the report to the Director.
