109Use of force
A person exercising a power specified in subsection (2) may, if he or she is exercising the power in an emergency, use such force as is reasonably necessary in the circumstances.
The powers are—
- a power to take or retake a person under any of sections 21(a), 30(4), 40, 105(3) and (4), and 106(2):
- a power to detain a person under section 105(3) or (4):
- a power to enter premises under section 105(2).
The following persons may use such force as is reasonably necessary in the circumstances:
- where a patient is obliged to accept treatment in accordance with section 36(1), the person treating the patient:
- where a patient is obliged to comply with a direction in accordance with section 36(2), a person who has given a lawful direction to a patient.
If a person (not being a constable) uses force under this section,—
- the circumstances in which the force was used must be recorded as soon as practicable; and
- a copy of the record must be given to the Area Director as soon as practicable.
