Local Government (Rating) Act 2002

Rating of Māori freehold land - Discharge of charging orders

113: Notation and registration of discharge

You could also call this:

"Updating records when unpaid rates are paid off, fully or partly"

When a discharge of a charging order is granted under section 112, the Registrar of the Māori Land Court must update the charging order. You will see the update if the discharge is for the full amount of unpaid rates or just part of it. The update shows if the charging order is fully or partially discharged.

If the discharge is partial, the update will show the amount of rates still unpaid and the part of the land affected. The discharge must be registered according to section 123 or section 124 of Te Ture Whenua Maori Act 1993. This means following the rules set out in these sections.

In the case of a partial discharge, the charging order is registered to show the remaining balance of money and the land still affected. This ensures the records are accurate and up-to-date. You can find more information about this process in the relevant sections of the Act.
