17: Process to prepare and adopt water services delivery plan

When a territorial authority is getting ready to adopt a water services delivery plan, it must make a decision about it. You can find out more about what a water services delivery plan includes by looking at section 13(1)(k). The authority has to talk to people and make sure it is following the rules in sections 61 to 64 when it is thinking about a new model for delivering water services.

The authority does not have to talk to people about its whole water services delivery plan, but if it wants to, it must follow the rules in sections 62 to 64. Auckland Council is different and does not have to talk to people about its plans for delivering water services. If Auckland Council decides to talk to people, it must follow the rules in sections 62 to 64.

17Process to prepare and adopt water services delivery plan

  1. A territorial authority must adopt a water services delivery plan by resolution.

  2. In relation to an anticipated or proposed model or arrangement for delivering water services in its water services delivery plan (see section 13(1)(k)), a territorial authority must—

  3. undertake consultation; and
    1. ensure that its consultation and decision-making complies with sections 61 to 64.
      1. Except as required under subsection (2), this Act does not require a territorial authority to consult on a draft or final water services delivery plan.

      2. However, if a territorial authority decides to consult on a part of its water services delivery plan, other than a model or arrangement described in subsection (2), it must do so in accordance with sections 62 to 64.

      3. Despite subsection (2), Auckland Council is not required (under this Act or any other Act) to consult on its anticipated or proposed model or arrangements for delivering water services in its water services delivery plan, but—

      4. may decide to consult; and
        1. if it decides to consult, must do so in accordance with sections 62 to 64.
