When two or more territorial authorities are thinking about setting up or changing a joint water services company, they can use a joint committee to help. This joint committee can do tasks like identifying options under section 61(2) of this Act or section 77(1) of the LGA2002. They can also recommend a proposal to the territorial authorities for consultation.

The joint committee can undertake consultation on behalf of the territorial authorities if they are allowed to do so. After consultation, they can recommend a decision to the territorial authorities. You should know that this is in addition to what is already in Schedule 7 of the LGA2002 about joint committees.

When the joint committee is doing these tasks, they can be treated like a local authority under Part 6 of the LGA2002, which is about planning, decision-making, and accountability. If three or more territorial authorities are involved, some of them can use a joint committee to do these tasks, but not all of them have to.

66Joint committees

  1. 2 or more territorial authorities that are considering whether or not to establish or amend a joint WSCCO, a joint arrangement, or a joint local government arrangement under section 137 of the LGA2002 may use a joint committee appointed under clause 30(1)(b) of Schedule 7 of the LGA2002 to perform 1 or more of the following tasks:

  2. identify and assess the options under section 61(2) of this Act or section 77(1) of the LGA2002:
    1. recommend a proposal to the territorial authorities for the purposes of consultation:
      1. if the territorial authorities have authorised the joint committee to do so, undertake consultation on behalf of the territorial authorities:
        1. following all required consultation, recommend a decision to the territorial authorities.
          1. This section applies in addition to, and without limiting, any provision in Schedule 7 of the LGA2002 that relates to joint committees.

          2. For the purposes of a joint committee performing any of the tasks listed in subsection (1), a reference in Part 6 of the LGA2002 (planning, decision-making, and accountability) to a local authority may be read as a reference to the joint committee.

          3. If 3 or more territorial authorities are considering whether or not to establish or amend a joint WSCCO, a joint arrangement, or a joint local government arrangement, some (but not all) of the territorial authorities may use a joint committee to perform the tasks listed in subsection (1).
