27: Role of Crown facilitator

The Crown facilitator helps you prepare a water services delivery plan. They can assist you to write the plan or advise you on how to do it. The Crown facilitator can also help you make changes to the plan if the Secretary asks you to. You can be directed by the Crown facilitator on how to prepare or amend the plan. The Crown facilitator can help you work with other territorial authorities to agree on a joint arrangement, such as by coordinating negotiations.

The Crown facilitator can assist you to put the accepted plan into action or advise you on how to do it. They can also direct you to give effect to the plan. The Crown facilitator helps you follow the rules in this Act. They can do other tasks as specified in their terms of reference.

If the Crown facilitator is helping you work with other territorial authorities, they can only determine the terms of the joint arrangement if you agree to it. As part of their role, the Crown facilitator can recommend to the Minister that they take further action, such as appointing a Crown water services specialist or taking action under Part 10 of the LGA2002.

27Role of Crown facilitator

  1. A Crown facilitator for water services delivery plans may be appointed to do 1 or more of the following:

  2. assist the relevant territorial authority or group of territorial authorities to prepare a water services delivery plan:
    1. advise the relevant territorial authority or group of territorial authorities how to prepare a water services delivery plan:
      1. assist the relevant territorial authority or group of territorial authorities to amend a draft water services delivery plan after being advised to do so by the Secretary (see section 20(3)(a)):
        1. direct the relevant territorial authority or group of territorial authorities how to do 1 or both of the following:
          1. prepare a water services delivery plan:
            1. if the Secretary has required a water services delivery plan to be amended (see section 20(3)(a)), amend a water services delivery plan:
            2. assist 2 or more territorial authorities to agree on the terms of a joint arrangement, including, for example, by co-ordinating the negotiation process or by determining the terms of the joint arrangement:
              1. assist the territorial authority or group of territorial authorities to give effect to an accepted water services delivery plan:
                1. advise the territorial authority or group of territorial authorities how to give effect to an accepted water services delivery plan:
                  1. direct the territorial authority or group of territorial authorities to give effect to an accepted water services delivery plan:
                    1. assist a territorial authority or group of territorial authorities to comply with the requirements in this Act:
                      1. anything else specified in the Crown facilitator’s terms of reference.
                        1. However, a Crown facilitator may be appointed to determine the terms of a joint arrangement in accordance with subsection (1)(e) only if the relevant territorial authorities agree to the Crown facilitator having that role.

                        2. As part of performing its role, a Crown facilitator may also recommend to the Minister that the Minister should take further action, for example, by—

                          1. taking further action under Part 10 of the LGA2002.
