Ministerial powers in relation to water services delivery plans: Crown facilitator for water services delivery plans
27Role of Crown facilitator
A Crown facilitator for water services delivery plans may be appointed to do 1 or more of the following:
- assist the relevant territorial authority or group of territorial authorities to prepare a water services delivery plan:
- advise the relevant territorial authority or group of territorial authorities how to prepare a water services delivery plan:
- assist the relevant territorial authority or group of territorial authorities to amend a draft water services delivery plan after being advised to do so by the Secretary (see section 20(3)(a)):
- direct the relevant territorial authority or group of territorial authorities how to do 1 or both of the following:
- prepare a water services delivery plan:
- if the Secretary has required a water services delivery plan to be amended (see section 20(3)(a)), amend a water services delivery plan:
- prepare a water services delivery plan:
- assist 2 or more territorial authorities to agree on the terms of a joint arrangement, including, for example, by co-ordinating the negotiation process or by determining the terms of the joint arrangement:
- assist the territorial authority or group of territorial authorities to give effect to an accepted water services delivery plan:
- advise the territorial authority or group of territorial authorities how to give effect to an accepted water services delivery plan:
- direct the territorial authority or group of territorial authorities to give effect to an accepted water services delivery plan:
- assist a territorial authority or group of territorial authorities to comply with the requirements in this Act:
- anything else specified in the Crown facilitator’s terms of reference.
However, a Crown facilitator may be appointed to determine the terms of a joint arrangement in accordance with subsection (1)(e) only if the relevant territorial authorities agree to the Crown facilitator having that role.
As part of performing its role, a Crown facilitator may also recommend to the Minister that the Minister should take further action, for example, by—
- appointing a Crown water services specialist; or
- taking further action under Part 10 of the LGA2002.
