When this law started, some parts of national parks were being run under a different law called the Tourist and Health Resorts Control Act. These parts will keep being run under that law, but they're still part of the national park.

The Governor-General can decide to change how some park land is run. They can say that part of a national park should be run under the Tourist and Health Resorts Control Act. To do this, they need to talk to the Minister of Tourism and a group called the Authority. They will make an official order to say when this change will happen.

The Governor-General can also decide that land in a national park should stop being run under the Tourist and Health Resorts Control Act. They need to talk to the Minister and the Minister of Tourism before doing this.

Before the Minister makes any decisions or rules that might affect how the Tourist and Health Resorts Control Act works, they need to talk to the Minister of Tourism first.

There's a special place called Te Papa-Kura-o-Taranaki. The rule about the Governor-General changing how park land is run doesn't apply to this place.

10Park land administered under certain other Acts

  1. Any land that, at the commencement of this Act, is part of a national park and is being administered under the Tourist and Health Resorts Control Act 1908 shall continue to be administered under that Act, but otherwise shall remain part of the park.

  2. Notwithstanding anything in the Tourist and Health Resorts Control Act 1908, the Governor-General may from time to time, by Order in Council made on the recommendation of the Minister after consultation with the Minister of Tourism and the Authority, declare that any land described in the order, being part of a national park, shall be administered under the Act, and as from the date of the Order in Council or from such later date as may be specified in the order, the land shall be so administered, but otherwise shall remain part of the park.

  3. Where any land that is part of a national park is being administered under the Tourist and Health Resorts Control Act 1908, the Governor-General may, by Order in Council made on the recommendation of the Minister and the Minister of Tourism, declare that the land shall cease to be administered under that Act.

  4. The Minister shall consult with the Minister of Tourism before—

  5. making any decision or taking any action under this Act that affects the administration of the Tourist and Health Resorts Control Act 1908; or
    1. making any bylaw under section 56 that affects the administration of the Tourist and Health Resorts Control Act 1908.
      1. Nothing in subsection (2) applies to Te Papa-Kura-o-Taranaki.
