58: Application of proceeds where land excluded from national park

When land is removed from a national park and then sold by the government, the money from the sale goes into a special government bank account. The Minister can decide to use this money in two ways:

If the land is sold outright, the Minister can use all the money from the sale for things that help national parks, as described in section 57.

If the land is sold with a payment plan or rented out, the Minister can use either the full sale price or rental value, or just the payments that have been made so far, for things that help national parks.

This rule also applies to land that was taken out of national parks before this law was made. If that land is sold after this law started, the money from the sale is treated the same way as if the land had just been removed from a national park.

58Application of proceeds where land excluded from national park

  1. Where any land is excluded from any park and the land is subsequently alienated by the Crown the proceeds of the alienation shall be paid into a Crown Bank Account, and the following provisions shall apply:

  2. except in a case to which paragraph (b) applies, an amount equal to the proceeds of the sale may, if the Minister so directs, be paid out of public money, and applied in accordance with section 57:
    1. where the land is sold on deferred-payment licence or is granted on Crown lease, there may, if the Minister so directs, be paid out of public money, and applied in accordance with section 57
      1. an amount equal to the purchase price payable under the deferred-payment licence, or, as the case may be, the rental value of the lease; or
        1. an amount equal to the instalments (including interest) paid under the deferred-payment licence, or, as the case may be, the rent paid under the lease.
        2. Where, before the commencement of this Act, any land was excluded from a national park, then, notwithstanding anything in any other Act, subsection (1) shall apply with respect to the proceeds of any alienation of the land received after the commencement of this Act as if the land had been excluded from the national park under section 11.
