Part 2Registration, occupation right agreements, and related requirements and rules
Suspension of registration
18Suspension of registration
The Registrar may suspend the registration of any retirement village if he or she considers that—
- any registered document is likely to mislead or deceive any resident, any intending resident, or the public; or
- the operator is failing to comply with this Act or any regulations made under this Act; or
- any prescribed fee required to be paid by the operator of the retirement village is not paid.
The Registrar must give notice of the suspension to the operator of the retirement village and to the statutory supervisor of the village (if there is one), and that notice must specify—
- the reason for the suspension; and
- the steps required to be undertaken by the operator to have the suspension lifted.
Once the operator of a retirement village has received notice of its suspension of registration, the operator, while the suspension is in force,—
- must take all reasonable steps to withdraw any advertisement or offer of occupancy relating to the retirement village:
- must not enter into any occupation right agreement relating to the retirement village with any person.
