You can ask for a dispute to be resolved by a disputes panel by giving the other party a dispute notice. You must follow some rules before you can do this. If you are a resident, you must have already taken your complaint to the complaints facility and waited 20 working days. You cannot ask for a dispute to be resolved by a disputes panel if you are a resident, except in certain situations, such as the one mentioned in section 53(3). If you are an operator, you must have told the resident about the dispute and tried to resolve it with them. You must have also waited 20 working days after telling the resident about the dispute. As a resident or operator, you have to meet these conditions before you can ask for a dispute to be resolved by a disputes panel.

52Resident or operator may require dispute resolution

  1. A resident or the operator may require that a dispute be resolved by a disputes panel by giving the other party or parties a dispute notice.

  2. A resident may not require resolution of a dispute (other than a dispute referred to in section 53(3)) by a disputes panel unless—

  3. the dispute has earlier been referred to the complaints facility; and
    1. 20 working days have elapsed since referral to the complaints facility.
      1. An operator may not require resolution of a dispute by a disputes panel unless—

      2. the operator has notified the resident concerned of the dispute; and
        1. the operator has made reasonable efforts to resolve the dispute with the resident; and
          1. 20 working days have elapsed since the resident was notified.
