You need to know what happens when there is a dispute in a retirement village. If you are the operator, you must send a copy of the dispute notice to the statutory supervisor as soon as possible. This is if the dispute affects many residents, the village's operation, or your rights and obligations. You also need to send the notice if it is given under section 53(3). After sending the notice, you must tell the people involved in the dispute that the statutory supervisor knows about it. This rule does not stop residents from telling the statutory supervisor about a dispute they are involved in.

55Operator must notify statutory supervisor of certain disputes

  1. The operator must forward to the statutory supervisor (if there is one) a copy of a dispute notice as soon as practicable after the dispute notice has been given if—

  2. the operator considers that the outcome of the dispute may affect—
    1. a significant number of the retirement village's residents; or
      1. the general operation of the village; or
        1. the operator's rights and obligations under the deed of supervision; or
        2. the dispute notice has been given under section 53(3).
          1. The operator must, immediately after forwarding a dispute notice to the statutory supervisor, advise the parties to the dispute that the statutory supervisor has been notified of the dispute.

          2. This section does not limit the right of a resident to inform the statutory supervisor of, or otherwise involve the statutory supervisor in, a dispute to which the resident is a party and for which a dispute notice may be given.
