24V: Timing of panel decisions

When a panel needs to make decisions about an application, they normally have to do this within 25 working days after the date when people were asked to give their comments. This date is set out in [section 24M].

Sometimes, if the application is very big or complicated, the panel might not be able to make their decisions in 25 working days. If this happens, they can choose to take more time. They can decide how much extra time they need.

If the panel decides to take more time, they need to tell some people about it. The Environmental Protection Authority (EPA) will send a written notice to let these people know:

  • The person who put in the application
  • Any government agency that was asked for advice or a report (if they haven’t given it yet)
  • The chief executive, if they were asked for a recommendation (if they haven’t given it yet)
  • Anyone who was invited to give comments about the application (but only if they were asked after the panel decided to take more time)

This helps make sure everyone knows what’s happening with the application and when to expect the panel’s decisions.

24VTiming of panel decisions

  1. The panel must issue its decisions under section 24W no later than 25 working days after the date specified for receiving comments under section 24M .

  2. However, if the scale or nature of matters raised by the substantive application is such that the panel is unable to issue its decisions within that time frame, the panel may extend the time frame as the panel considers appropriate.

  3. If the panel extends the time frame under subsection (2) , the EPA must give written notice of the extension to—

  4. the authorised person who lodged the substantive application; and
    1. if advice or a report has been requested from an agency under section 24G and is yet to be provided to the EPA, that agency; and
      1. if a recommendation has been requested from the chief executive under section 24FA and is yet to be made, the chief executive; and
        1. if the extension decision is made after persons or groups are invited to provide comments under section 24AC or 24M , those persons or groups.
