If you’ve been given permission to pause your application under section 64(3), you can ask the EPA in writing to start working on it again. When you do this, the panel must start processing your application once more.

Even if you don’t ask, the panel can decide on its own to start working on your application again. They can do this using section 66(2)(b).

When the panel starts working on your application again, the EPA must tell everyone who was told about the pause that the work has restarted. They’ll do this in writing and say when the panel started working on it again.

If you’re one of the people or groups who was told about the pause, and you get a notice saying the work has restarted, you must start working on the application again too.

65Resumption in processing of substantive application following suspension under section 64

  1. An applicant granted a suspension under section 64(3) may request in writing to the EPA that the processing of the substantive application be resumed.

  2. If a request is made under subsection (1), the panel must resume processing the substantive application.

  3. The panel may decide under section 66(2)(b) to resume processing the substantive application in the absence of a request under subsection (1).

  4. If a panel resumes processing a substantive application under subsection (2) or (3), the EPA must give written notice of that fact, specifying the date on which the panel resumed processing, to the persons or groups notified of the suspension under section 64(4).

  5. A person referred to in section 64(4)(b) or (c) must resume processing the substantive application if they receive a notice under subsection (4).
