75: Panel may transfer decision to appropriate Minister

You should know that a panel can give the job of making a decision to the right Minister. This can happen before the panel decides on an approval under section 81. The approval they’re talking about is mentioned in section 73.

The panel can do this if they’re not sure about two things. First, if they don’t think they have enough information to figure out what risks the Crown might face if they say yes to the approval. Second, if they’re not sure that saying yes to the approval would protect the Crown enough from possible problems that could come up later.

75Panel may transfer decision to appropriate Minister

  1. At any time before a panel makes a decision under section 81 on an approval referred to in section 73, the panel may transfer the decision to the appropriate Minister for the land to which the approval relates.

  2. The panel may transfer the decision if the panel—

  3. is not satisfied that the panel has adequate information to assess the risks to the Crown arising from any decision by the panel to grant the approval:
    1. is not satisfied that any decision by the panel to grant the approval could adequately mitigate the potential liabilities of the Crown arising from that decision.
