If the application is accepted under section 21(1)(a) or (c), the Minister can refer the whole project. If the application is accepted under section 21(1)(b)(ii), the Minister will only refer the alternative part of the project that was suggested. 26Referral of project if referral application accepted

  1. This section applies if the Minister accepts a referral application under section 21.

  2. The Minister may,—

  3. if the application is accepted under section 21(1)(a) or (c), refer the whole project:
    1. if the application is accepted under section 21(1)(b)(i), refer—
      1. the whole project; or
        1. the part of the project that has been proposed as an alternative:
        2. if the application is accepted under section 21(1)(b)(ii), refer the part of the project that has been proposed as an alternative.
          1. If the Minister refers a part of a project under subsection (2)(b)(ii) or (c) of this section, that part of the project constitutes the referred project.
