12Notice of request to grant right of access for proposed access arrangement

  1. This section applies if a proposed approval is an approval described in section 42(4)(l) or (m) (access arrangement).

  2. Before lodging the referral application, the applicant must comply with section 59(1) and (2) of the Crown Minerals Act 1991 (which applies as if a reference to an access arrangement under that Act were a reference to an access arrangement under this Act).

  3. If a referral application is to be lodged by more than 1 person, the person who is the proposed holder of the approval referred to in subsection (1) must comply with this section.
