45: Withdrawal of substantive application

You can withdraw your application for approvals at any time before a panel makes its decisions. To do this, you need to give written notice to the EPA. If you’ve already reached certain stages in the process, you might need to notify other people too.

If you’ve already asked for something under section 48, you need to tell the relevant chief executive that you’re withdrawing. If people or groups have been invited to give written comments under section 35 or 53, you need to let those people or groups know as well.

Once you’ve told the EPA that you’re withdrawing, they will let the panel know that you’ve withdrawn your application.

45Withdrawal of substantive application

  1. At any time before a panel makes its decisions under section 81 on the approvals sought in a substantive application, the applicant may withdraw the application by giving written notice—

  2. to the EPA; and
    1. if the withdrawal occurs after a request is made under section 48, to the relevant chief executive; and
      1. if the withdrawal occurs after persons or groups are invited to provide written comments under section 35 or 53, to those persons or groups.
        1. After receiving a notice under subsection (1)(a), the EPA must advise the panel that the substantive application has been withdrawn.
