You can still apply for approval under another Act for a listed or referred project. If you do this, you might need to withdraw that application if you also apply under this Act for the same activity. You will need to withdraw the other application if the EPA tells you that your application under this Act meets certain requirements, such as those in section 46(2).

94Use of specified Act to apply for approval

  1. This Act does not prevent any person from applying for an approval under a specified Act in relation to a listed project or a referred project.

  2. However, a person must withdraw an application for an approval under a specified Act if they—

  3. lodge a substantive application that seeks a corresponding approval under this Act for the same, or substantially the same, activity; and
    1. are notified by the EPA that the substantive application complies with section 46(2).
      1. The person must withdraw the application within 5 working days after receiving the notice referred to in subsection (2).
