25: Timing of decision to decline referral application

25Timing of decision to decline referral application

  1. A decision to decline a referral application may be made, in accordance with section 21,—

  2. before or after comments on the application are invited under section 17(1):
    1. before or after a report on the application is obtained under section 18 or 19:
      1. whether or not further information on the application is requested and provided under section 20.
        1. However, if a report has been obtained, or if comments or further information have been sought and provided within the required time frame, the Minister must consider those things, along with the referral application, before deciding to decline the application.
