When you apply to have something referred, the decision to decline your application can be made at different times. This decision can be made before or after people are asked for their comments on your application, as stated in section 17(1). It can also be made before or after a report on your application is obtained, as stated in section 18 or 19, or whether or not you are asked for more information, as stated in section 20. If a report has been obtained, or if comments or more information have been asked for and provided on time, the Minister must think about those things, along with your application, before deciding to decline it. The Minister has to consider all the information before making a decision to decline your application.

25Timing of decision to decline referral application

  1. A decision to decline a referral application may be made, in accordance with section 21,—

  2. before or after comments on the application are invited under section 17(1):
    1. before or after a report on the application is obtained under section 18 or 19:
      1. whether or not further information on the application is requested and provided under section 20.
        1. However, if a report has been obtained, or if comments or further information have been sought and provided within the required time frame, the Minister must consider those things, along with the referral application, before deciding to decline the application.
