97: Commencement of approval

When you get an approval under this law, it usually starts working on the day the panel issues their decision document. However, the panel can choose a later date for the approval to begin if they want to.

There are some special cases where the start date might be different:

For coastal permits that need an aquaculture decision, there are specific rules about when they start.

If the approval is for a designation, concession, land exchange, conservation covenant, archaeological authority, access arrangement, or mining permit, there are different rules for each one. These rules are written in other parts of the law, and they tell you exactly when these special types of approvals start.

So, depending on what kind of approval you have, you might need to look at a different part of the law to know when it begins.

97Commencement of approval

  1. Subject to subsection (2), an approval granted under this Act commences—

  2. on the date on which the panel’s decision document for the approval is issued under section 88; or
    1. on any later date specified by the panel in the decision document.
      1. For the purposes of subsection (1), the following apply:

      2. for an approval described in section 42(4)(a) or (b) that is a coastal permit for which an aquaculture decision is required under section 80 and the aquaculture decision includes a reservation, clauses 22 and 35 of Schedule 5:
        1. for an approval described in section 42(4)(d) (designation), clause 30 of Schedule 5:
          1. for an approval described in section 42(4)(e) (concession), clause 12 of Schedule 6:
            1. for an approval described in section 42(4)(f) (land exchange), clause 35 of Schedule 6:
              1. for an approval described in section 42(4)(g) (conservation covenant), clause 48 of Schedule 6:
