22C: Referral of project if referral application accepted

If the Minister accepts your referral application under section 22A, they can decide what to refer. If they accepted your application under section 22A(1)(a) or (c), they can refer your whole project. If they accepted your application under section 22A(1)(b)(i), they can refer either your whole project or just the part you suggested as an alternative. If they accepted your application under section 22A(1)(b)(ii), they will only refer the part you suggested as an alternative. When the Minister refers just a part of your project, that part becomes what’s called the “referred project”.

22CReferral of project if referral application accepted

  1. This section applies if the Minister accepts a referral application under section 22A .

  2. The Minister may,—

  3. if the application is accepted under section 22A(1)(a) or (c) , refer the whole project:
    1. if the application is accepted under section 22A(1)(b)(i) , refer—
      1. the whole project; or
        1. the part of the project that has been proposed as an alternative:
        2. if the application is accepted under section 22A(1)(b)(ii) , refer the part of the project that has been proposed as an alternative.
          1. If the Minister refers a part of a project under subsection (2)(b)(ii) or (c) of this section, that part of the project constitutes the referred project.
