1Transitional and savings provisions effective after commencement of Coroners Amendment Act 2016
1Interpretation
In this schedule,—
amendment Act means the Coroners Amendment Act 2016
commencement date means the date on which the Coroners Amendment Act 2016 comes into force
date of death means—
- the date on which a death occurred; or
- if the date on which a death occurred is unknown, the date on which the death is first discovered.
2Application of Act to deaths occurring before commencement date
This clause applies in respect of a death if the date of death is earlier than the commencement date.
Despite the commencement of the amendment Act, the following sections apply in respect of the death as if the amendment Act had not come into force:
- section 13:
- section 14:
- section 15:
- section 71:
- section 139.
If the death is reported to the coroner on or after the commencement date, the rest of this Act applies in respect of the death (except that, in section 18(1)(a), the reference to section 13(2) must be treated as a reference to section 13 as it read before the commencement date).
If the death is reported to the coroner before the commencement date, clause 3 applies.
3Application of Act to deaths reported to coroner before commencement date
This clause applies in respect of a death that was reported to a coroner under section 15 before the commencement date.
Despite the commencement of the amendment Act, the following sections apply in respect of the death as if the amendment Act had not come into force:

Despite the commencement of the amendment Act, the following sections do not apply in respect of the death:
- section 21A:
- section 57A:
- section 57B:
- section 59A:
- section 71A:
- section 133A.
4Practice notes issued by chief coroner saved
A practice note issued by the chief coroner under section 132 before the commencement date continues in force until revoked by the chief coroner.
5Designated coroners continued
This clause applies to a coroner who, before the commencement date, was a designated coroner (within the meaning of section 9 as it read before the commencement date).
In respect of deaths where the date of death is earlier than the commencement date, the coroner remains the designated coroner (within the meaning of section 9 as it read before the commencement date).
In respect of deaths where the date of death is on or after the commencement date, the coroner must be treated as a designated coroner (within the meaning of section 9 as amended by the amendment Act).
2Provisions relating to Coroners Amendment Act 2023
6Interpretation for this Part
In this Part, commencement date means the date on which this Part comes into force.

7Continuation of section 77 if coroner has given notice before commencement date
Section 77 (as it read before the commencement date) continues to apply as if the Coroners Amendment Act 2023 had not been enacted if—
- a coroner gives notice under section 77(1)(a) before the commencement date; and
- the coroner receives a notification of the kind referred to in section 77(1)(b)—
- before, on, or after the commencement date; but
- within the notification period stated in the notice.
