Trade Marks Act 2002

Legal proceedings - Civil proceedings for infringement - When infringement proceedings may be brought

100: Time for bringing proceedings for infringement of registered trade mark

You could also call this:

"When you can sue someone for using your registered trade mark without permission"

If you own a registered trade mark, you can take legal action if someone uses it without your permission. You can do this in two situations:

  1. If you applied for your trade mark under a special rule called section 36, you can take action for any misuse that happened on or after the day you applied to register your trade mark in New Zealand.

  2. For all other registered trade marks, you can take action for any misuse that happened on or after the day your trade mark is considered to be registered.

This means you can't take legal action for things that happened before these dates, even if your trade mark is registered now.
