38Point-of-sale health information or warning signs
This section applies if regulations made under section 81(1)(15) requiring point-of-sale health information or warnings are in force.
A person to whom those regulations apply who offers a regulated product for sale (by retail or wholesale) must—
- display a sign for the public that—
- does no more than communicate health information or warnings; and
- complies with those regulations; and
- does no more than communicate health information or warnings; and
- display the sign clearly at each point of sale at the outside of or inside the person's place of business.
A person who, without reasonable excuse, contravenes subsection (2) commits an offence and is liable to a fine not exceeding $2,000.
