If you sell regulated products, you must follow certain rules. You have to display a notice at the point of sale, which is where you sell the products, saying that you cannot sell these products to people under 18 years old. The notice must also follow any other rules set out in the regulations made under section 81(1)(17).

If you do not display this notice, you can get a fine of up to $2,000, unless you have a good reason for not doing so. You must make sure the notice is clear and easy to see, both inside and outside your place of business.

You must only put information on the notice about not selling regulated products to people under 18 years old, and you must follow any other rules about what the notice should look like and what it should say, as set out in the regulations.

43Point-of-sale purchase age information

  1. This section applies if regulations made under section 81(1)(17) requiring point-of-sale purchase age information or warnings are in force.

  2. A person to whom those regulations apply who offers a regulated product for sale by retail must display clearly at each point of sale at the outside of or inside the person's place of business a notice for the public that—

  3. does no more than communicate information or warnings to the effect that the sale of regulated products to people who are younger than 18 years is prohibited; and
    1. complies with any requirements of those regulations.
      1. A person who, without reasonable excuse, contravenes subsection (2) commits an offence and is liable to a fine not exceeding $2,000.
