20R: Obligation of person selling notifiable products

If you sell notifiable products in New Zealand, you must tell the Director-General that you are selling these products and give the name and address of each place where you sell them. You must do this every year before the anniversary of when you first told them. You have to use a database to notify the Director-General, and you must follow the rules set out in regulations.

If you do not tell the Director-General that you are selling notifiable products, or if you do not renew your notification, you can get a fine of up to $5,000 if you do not have a good reason for not doing so.

Notification obligations

20RObligation of person selling notifiable products

  1. A person who sells notifiable products in New Zealand must notify the Director-General that they are selling the products and the name and address of each premises from which they are selling the products.

  2. A person who sells notifiable products in New Zealand must renew their notification each year before the anniversary of their previous notification.

  3. A notification (including a renewal of a notification) must be made on the database in accordance with requirements in regulations.

  4. A person who, without reasonable excuse, fails to notify the Director-General that they are selling a notifiable product or fails to renew a notification commits an offence and is liable to a fine not exceeding $5,000.
