48: Automatic vending machines must display health messages required by or under this Act

If you sell a regulated product from a vending machine that people can see, you must display health messages on the machine. You have to show these messages even if only you or your employees can use the machine. You must display the health messages in the way the regulations say.

If you sell a regulated product from a vending machine and do not display the required health messages, you can get in trouble. You might have to pay a fine of up to $5,000 if you do not have a good reason for not showing the messages.

You still have to follow other rules, like those in section 47, even if you display the health messages on your vending machine.

48Automatic vending machines must display health messages required by or under this Act

A person who sells a regulated product from an automatic vending machine that can be seen from a place to which members of the public have access—
must display on the machine any health message required by or under this Act (even if the machine is accessible only by the person or their employees or agent); and
must display the health message in accordance with regulations.

A person commits an offence if the person—
offers for sale a regulated product by way of an automatic vending machine; and
fails, without reasonable excuse, to display on that machine any health message required by or under this Act.

A person who commits an offence against subsection (2) is liable to a fine not exceeding $5,000.
Subsection (1) does not authorise or excuse a contravention of section 47.
