If you make a complaint to the district inspector under section 97, they will investigate it if it is not about a breach of a right under the Code of Rights. The district inspector will try to talk to you, the person who complained for you, the care manager, and everyone else involved in your case. They want to hear from everyone to understand what happened.

The district inspector will look into your complaint and if they think it is a valid concern, they will either start an inquiry under section 101 or report the issue to the care manager with some recommendations. They will try to figure out what is going on and what should be done about it.

98Investigation by district inspector

  1. If a complaint made or referred to the district inspector under section 97 is not a complaint that concerns a breach of a right under the Code of Rights, the district inspector must investigate the complaint.

  2. In investigating a complaint, the district inspector must try to talk with the care recipient, any person who complained on behalf of the care recipient, the care manager, and everyone else involved in the case.

  3. If, after investigating the complaint, the district inspector is satisfied that the complaint has substance, the district inspector must—

  4. conduct an inquiry under section 101 into the complaint; or
    1. report the matter together with any recommendations to the care manager.
      1. The district inspector must send a copy of any report prepared under subsection (3)(b) to the Director-General of Health.
