When a specialist assessor fills out a certificate for you, they must say if they think you still need care. They do this under a part of the law called section 79. They will decide if you need to keep getting care or not.

The specialist assessor has two options to choose from when filling out the certificate for you. They can say you still need care as a care recipient. They can also say you do not need care as a care recipient anymore.

This happens when you are no longer part of the criminal justice system or if you are liable to detention under a sentence. The specialist assessor will give their opinion on what they think is best for you. They will write this opinion in the certificate under section 79.

  1. When a specialist assessor completes a certificate, under section 79, in respect of a care recipient no longer subject to the criminal justice system or a special care recipient who is liable to detention under a sentence, the specialist assessor must state whether in his or her opinion—

  2. the care recipient still needs to be cared for as a care recipient; or
    1. the care recipient no longer needs to be cared for as a care recipient.
