The co-ordinator must make sure some people's needs are assessed. You might need an assessment if you are required to have one by the Criminal Procedure (Mentally Impaired Persons) Act 2003. This includes people who have been found unfit to stand trial.

You might also need an assessment if you have been acquitted on the ground of insanity or convicted. The co-ordinator must also assess people who have been found to have an intellectual disability. This is according to section 38 of the Act.

15Needs assessments required for certain care recipients

  1. The co-ordinator must ensure that the needs of the following persons are, or have been, assessed in accordance with this Part:

  2. every person whose assessment is required by section 23(5) or section 35(4) of the Criminal Procedure (Mentally Impaired Persons) Act 2003:
    1. every person who is a care recipient because of an order made under the Criminal Procedure (Mentally Impaired Persons) Act 2003, following—
      1. a finding that the person is unfit to stand trial; or
        1. the acquittal of the person on the ground of insanity; or
          1. the conviction of the person:
          2. every person who, in accordance with section 38, has been assessed as having an intellectual disability:
            1. every patient who, in accordance with section 47A of the Mental Health (Compulsory Assessment and Treatment) Act 1992, is removed to a facility.
