48D: Restrictions on providing compulsorily acquired information and investigative assistance

The Commission can’t give information or help to overseas regulators if they got that information or help by forcing someone to provide it. There are only two situations where they can share this kind of information or help:

  1. They can share it with a recognised overseas regulator if there’s an agreement in place to work together.

  2. They must follow the rules set out in sections 48I to 48K when sharing this information or help.

48DRestrictions on providing compulsorily acquired information and investigative assistance

  1. The Commission must not provide compulsorily acquired information or investigative assistance to an overseas regulator unless the information or assistance is provided—

  2. to a recognised overseas regulator in accordance with a co-operation arrangement; and
    1. in accordance with sections 48I to 48K.
