Declaration of unfair contract terms
46KTerms that may not be declared to be unfair contract terms
A court may not declare a term in a standard form consumer contract or standard form small trade contract to be an unfair contract term to the extent that the term—
- defines the main subject matter of the contract; or
- sets the upfront price payable under the contract; or
- is a term required or expressly permitted by any enactment.
In this section, upfront price means the consideration (including any consideration that is contingent upon the occurrence or non-occurrence of a particular event) payable under the contract, but only to the extent that the consideration is set out in a term that is transparent.
