Fair Trading Act 1986

Enforcement and remedies - Enforceable undertakings

46AA: Matters included in undertakings

You could also call this:

“What you can include when you promise to fix a problem”

When you make a promise to fix a problem under section 46A, you can include different things in that promise. You might agree to pay money to someone who was affected by the problem, or do something else to help fix the issue. You could also agree to pay some or all of the money that the Commerce Commission spent looking into the problem.

If your promise includes paying money to someone or to the Commerce Commission, the Commission will tell everyone about it. They will say how much money you agreed to pay and give a short explanation of what happened.

In this part of the law, breaking the rules can mean different things. It can mean actually breaking the rules, helping someone else break the rules, or making someone break the rules. It can also mean being involved in breaking the rules in any way, or working with others to break the rules.
