33B: Certificates of appointment

If you are a product safety officer or a trainee product safety officer, you must receive a certificate that shows you have been appointed to your job. This certificate proves that you are allowed to do your work.

The certificate will be made by the chief executive and will include important information about you and your job. It will have your full name on it. It will also say that you have been appointed under section 33A of the Fair Trading Act.

The certificate will mention the special powers you have for your job. These powers are described in sections 33C and 33D of the Act. If you have any powers under the Search and Surveillance Act 2012, the certificate will say what those powers are too.

33BCertificates of appointment

  1. Every product safety officer, and every trainee product safety officer, must be issued with a certificate as evidence of that person's appointment under section 33A.

  2. The certificate must be in a form determined by the chief executive and set out—

  3. the full name of the appointee; and
    1. a statement that the person is appointed under section 33A of this Act; and
      1. a reference to the powers of the appointee under sections 33C and 33D; and
        1. a statement of the powers (if any) of the product safety officer under the Search and Surveillance Act 2012.
