21BLiability of recipient of unsolicited services
If a person, in trade, provides unsolicited services to another person (the recipient), the recipient is not liable—
- to pay for the services; or
- for any loss or damage resulting from the provision of those services, unless the loss or damage resulted from a deliberate act by the recipient.
In this section and section 21C, unsolicited services—
- means services that have been provided to a recipient without any request for those services having been made by, or on behalf of, that recipient; but
- does not include reticulated gas or electricity.
